Terms of Use
These Terms govern your use of the O'Shares Invest website and platform. They are written to be read, not skimmed past: sections are numbered, obligations are named, and nothing here hides a promise of returns, because none exists. By creating an account you accept these Terms in full.
1. Who we are and what this service is
O'Shares Invest, trading name of O’Shares Invest Digital Services — demo entity, is an investment analysis service. We provide AI-assisted market analysis, dashboards, alerting and personal account management for self-directed investors. We are not a custodian of your funds: your money and assets remain in accounts you hold with your bank, card issuer or exchange, linked to our platform with read-only permissions.
We do not provide personalized investment advice in the regulated sense of a recommendation to buy or sell a specific security, and nothing on the platform should be read as such. Every trading decision is yours, made through your own accounts, under your own responsibility.
2. Eligibility
You must be at least the age of majority in your province or territory of residence, legally able to enter contracts, and resident in a jurisdiction where use of this service is lawful. Residents of sanctioned jurisdictions and individuals on prescribed lists cannot hold accounts. You confirm these facts during registration, and they are re-verified under our AML / KYC policy.
One person, one account. Accounts are personal and non-transferable; corporate or trust arrangements require written agreement from compliance before onboarding.
3. Permitted use
You may use the platform for its stated purpose: receiving analysis, configuring watchlists and alerts, and communicating with your account manager about your own investment activity. You may not resell access, scrape or reverse-engineer the platform, feed its outputs into mass-distribution channels, or use it to provide services to third parties.
You agree not to interfere with the platform's operation, not to probe or test its security without written authorization, and not to upload malicious code or unlawful content. Security research conducted responsibly is welcomed, coordinated in advance with our team.
4. Your account and its security
You are responsible for the accuracy of your registration data, for keeping your credentials confidential and for all activity under your account. Enable two-factor authentication; it takes two minutes and closes the most common attack path. Notify support immediately if you suspect unauthorized access.
We may suspend an account where we reasonably suspect compromise, fraud or a legal obligation, and we will tell you why unless the law forbids it. Suspension for security reasons freezes activity; it does not extinguish your balances, which remain yours and are returned per the withdrawal policy.
5. Fees, plans and payment
The plans, minimum deposits, subscription fees and payment methods are published on the Fees and pricing page and form part of these Terms. Subscriptions are billed monthly in Canadian dollars, C$19 for Basic, C$45 for Advanced, C$95 for Premium, and can be cancelled at the end of any billing month without penalty. Deposits and withdrawals processed through the platform carry no platform commission.
We may change fees prospectively with at least thirty days' notice by email. Changes never apply retroactively to a billing period already paid.
6. Deposits and withdrawals
Funding methods available to Canadian users, Interac e-Transfer, Visa, Mastercard and bank wire, with their processing times, are listed on the Deposit and withdrawal methods page. Withdrawals are governed by the Withdrawal policy, including the C$25 minimum, identity verification requirements and daily limits.
Funds deposited must originate from accounts in your own name. Third-party funding is returned to its source, and repeated attempts may close the account.
7. The analysis service and its limits
The AI engine summarizes market data; it does not predict the future. Outputs are informational, may be incomplete, may lag fast markets, and can be wrong. They are one input into your decisions, never a substitute for your own judgement or, where appropriate, advice from a licensed adviser. Trading involves risk, including total loss of the amounts you commit.
We may modify, suspend or discontinue features with notice where practical. Material reductions in a paid plan's functionality entitle you to cancel the affected subscription immediately with a pro-rata refund of the current month.
8. Intellectual property
The platform, its software, dashboards, analysis methods, texts and brand are our property or that of our licensors. You keep all rights in your own data, your watchlists, notes and personal information, and you may export them at any time in a machine-readable format.
You grant us the limited licence needed to operate the service: processing your data as described in the Privacy Policy and displaying your content back to you. That licence ends when your account closes.
9. Third parties
The service references and connects to third parties: exchanges whose data we read, payment processors who move your deposits, and infrastructure providers who host the platform. Their terms apply to their services, and we are not responsible for their outages, their fee changes or their failures, though we choose them carefully and monitor their performance.
10. Limitation of liability
To the maximum extent permitted by Canadian law, our aggregate liability arising from your use of the service is limited to the subscription fees you paid in the twelve months preceding the claim. We are not liable for indirect or consequential losses, including trading losses, missed opportunities or losses caused by events outside our reasonable control.
Nothing in these Terms excludes liability that cannot be excluded by law, including obligations under Canadian consumer-protection statutes, and nothing here limits your rights under the complaints process or the OBSI escalation route.
11. Termination
You may close your account at any time with notice; subscriptions stop at the end of the paid month and verified balances are withdrawn under the standard policy timeline. We may terminate for material breach, unlawful use, or where maintaining the relationship would breach our legal obligations, with written reasons except where prohibited.
12. Changes to these Terms
We may update these Terms. Material changes are notified by email at least thirty days before effect, and continued use after that date constitutes acceptance. The current version is always the one published on this page, dated below.
13. Governing law and contact
These Terms are governed by the laws applicable in Canada and the province where our office operates, without prejudice to mandatory consumer-protection rules of your province of residence. Questions about any clause can be directed to [email protected], and legal notices to the same address with LEGAL NOTICE in the subject line.
